1. Agreement

By accessing or using the Aware platform operated by Ware AI, Inc. ("Ware AI", "we", "us"), including the web dashboard, Mac application, Chrome extension, and gateway services (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use at support@wareit.ai.

4. Subscription & Billing

The Service is offered on a subscription basis. Pricing is listed on our website. All fees are in US dollars and are non-refundable except as required by law.

Your payment method will be charged at the start of each billing period. You may cancel your subscription at any time through the billing portal, and you will retain access until the end of your current billing period.

We reserve the right to change pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other users' instances or data
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to generate spam, malware, or harmful content
• Resell or redistribute the Service without our written consent
• Use browser automation to violate third-party terms of service

6. Your Data

You retain ownership of all data you create or upload through the Service. We do not use your data to train AI models. You grant us a limited license to process your data solely for the purpose of providing the Service.

7. AI-Generated Content

The Service uses third-party AI models to generate responses and perform actions. AI-generated content may not always be accurate, complete, or appropriate. You are responsible for reviewing and verifying any output before relying on it.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or data loss.

9. Limitation of Liability

To the maximum extent permitted by law, Ware AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time by canceling your subscription and contacting support.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
